The Dutch authorities have started their first-ever judicial proceedings for a breach of euthanasia laws. According to a statement by a public prosecutor in The Hague, a doctor gave a severe dementia sufferer a 'secret' dose of a sedative right before obtaining approval for the procedure. The medical complaints board has already found her guilty.

In November 2015 several psychiatrists, ethicists, lawyers and health professionals in Belgium gave voice to their profound concern: there is something fundamentally wrong with euthanasia in Belgium on the basis of purely psychological suffering. Two Belgian women, Sophie and Lotte Nys, just recently revealed the story of the death of Tine, their sister. On April 27 2010, Tine received euthanasia on the basis of " unbearable psychological suffering " because of "an incurable disease". Six years after the facts her family is still haunted by the experience and left behind with questions. Sophie and Lotte testified about this in a news programme of the Belgian - Flemish national television, Terzake (February 2) .

Tine Nys formulated her euthanasia request 4 months before her death. The fatal disease from which she suffered, autism, was diagnosed two months after the request. Fifteen years earlier Tine had been in psychiatric treatment for some time, and even attempted suicide. She clearly had gone through a very difficult period in her life. Yet, later on, she succeeded to build a regular life. She had a nice job, friends and family, all kinds of plans. 8 months before she died, however, she fell in a deep crisis after a relational break up and was haunted again by the wish to die: she went looking for a psychiatrist to help to end her life...

Accepting a mentally ill prisoner's request to be executed shows up the madness of Belgium's euthanasia laws.

The prisoner, Frank Van Den Bleeken, sought the right to be executed because he was 'suffering unbearably' from a life-long psychiatric condition, according to his lawyer Jos Vander Velpen...

De legalisering van euthanasie heeft tot een aantal merkwaardige paradoxen geleid die ernstige vragen oproepen.

1. Vaak wordt euthanasie gevraagd omwille van (de angst voor) ondraaglijk lijden. Daartegenover staat dat de medische knowhow nog nooit zo ver heeft gestaan als nu, ook voor het bestrijden van pijn en ongemak in de terminale levensfase. Nagenoeg alle pijn kan draaglijk gemaakt worden, met palliatieve zorg en desnoods met palliatieve sedatie. Daarbij hoort het vermijden van medische hardnekkigheid. Toch euthanasie toepassen kan dus beschouwd worden als het failliet van palliatieve zorg...

In 2001 werd Nederland het eerste land ter wereld om de euthanasie te legaliseren, zowel als bijstand bij zelfdoding. Er werden verscheidene grenzen geplaatst om te bepalen wie deze zou mogen inroepen; de artsen die deze grenzen zouden eerbiedigen zouden niet vervolgd worden. Omdat elk geval uniek is werden er vijf regionale toetsingscommissies opgericht om elk geval te onderzoeken en om vast te stellen of dit was gebeurd met eerbied voor de wet. Gedurende de vijf jaar die volgden op de afkondiging van de wet bleven de door de artsen geprovoceerde overlijdens op een stabiel niveau — sommige jaren daalde zelfs hun aantal. In 2007 schreef ik dat er "niet noodzakelijk een glijdende helling was in de euthanasie. Een goede euthanasiewet, samen met een toetsingsprocedure van de euthanasie, waarborgt een stabiel en relatief weinig belangrijk aantal van euthanasiegevallen". De meeste van mijn collega's kwamen tot dezelfde conclusie...

De Morgen bericht in een omstandig artikel over de studiereis van een groep artsen en verplegers, onder leiding van dokter Wim Distelmans, naar Auschwitz (DM 14/10). Blijkbaar ging het hier om een soort teambuilding uitstap van mensen uit de medische sector die zich wilden bezinnen over goede levenseindezorg, inclusief de euthanasiepraktijk zoals die in België sinds een decennium ingang heeft gevonden. Deze reis wou als het ware de problematiek van de 'waardige dood' onder de aandacht brengen op een plaats die het ultieme kwaad als zodanig symboliseert. Deze reis heeft in het buitenland en in de Joodse gemeenschap in België voor enige controverse gezorgd, maar daarover lijken Wim Distelmans en zijn medereizigers zich niet al te veel zorgen te maken...
